Grandmother Sues After Being Arrested At Disney For CBD Oil In Purse

Hester Burkhalter of Hickory, North Carolina, is suing Disney after she was arrested in 2019 at Walt Disney World in Orlando, Florida, for having CBD oil in her purse. 

Attorney Ben Crump filed the civil lawsuit on Burkhalter and her family’s behalf. 

In the complaint, Crump says Burkhalter was “wrongfully arrested and taken into custody at Walt Disney World in Orlando, Florida, for possessing federally legal CBD oil.” The lawsuit seeks $6 million in compensatory damages and $12 million in punitive damages for Burkhalter and millions more for her family. 

Filed in the Circuit Court of the 9th Judicial Circuit in Orange County against The Walt Disney Company as well as numerous executives, the Orange County Sheriff, and several deputies, the lawsuit alleges illegal detention, false arrest, and violation of civil rights. 

The following sequence of events is what is alleged in the complaint as well as during a news conference with Crump and Burkhalter. 

They allege that Burkhalter visited Walt Disney World with her husband, daughter, and two adopted children, ages eight and ten, and spent April 14, 2019 at various Disney parks before arriving at Magic Kingdom on April 15. There, Burkhalter was asked to remove the contents of her bag when going through security. The contents included a 1-oz container of CBD oil. 

Burkhalter told security she used the CBD oil to treat advanced arthritis at her doctor’s recommendation. When asked, she told security she didn’t know if the bottle contained THC.

The oil was then tested twice by a sheriff’s deputy, getting a positive result on the second try. Burkhalter was then separated from her family and placed under arrest for felony drug possession. 

Burkhalter alleges she was subjected to drug-sniffing dogs and a body cavity search. She says she vomited during transport and was denied medical care. 

“It was the most humiliating day of my life,” Burkhalter said during the news conference.

Disney has yet to respond to the allegations, while the Orange County Sheriff’s Office says it “has not been served with a lawsuit, but in any case, we don’t comment on possible pending litigation.”

NFL Hall of Famer Brett Favre Partners With CBD Brand

NFL Hall of Fame quarterback, Brett Favre, who took countless hits from opposing players during a 20-year career, has endorsed CBD for NFL players and partnered with CBD brand, Green Eagle. 

Favre has endorsed the CBD products as a source of pain relief. 

“Not that my opinion is mainstream in America, but if you’re like me you can’t help but go somewhere here or there and see something CBD-related,” he said. “My thought had been, ‘That’s probably a bunch of pot smokers.’ That’s not the case.”  

After speaking with Green Eagle CEO, Joseph Smadja, Favre used CBD products to prepare for a half-marathon and was surprised by and impressed with the results. Favre, who has a past with substance abuse, was drawn to CBD because of its non-addictive qualities.

“Me being an advocate of a non-addictive pain reliever — it’s what I thought was a good fit,” he said.

“At some point, it will be readily available in mainstream sports. How soon? It’s hard to say.” 

Favre believes CBD offers a safer alternative for pain relief. As the NFL relaxed some of its marijuana-related policies as part of its most recent collective bargaining agreement, it could open the door for CBD products in the future.
